RECOMMENDATION OF THE ADMINISTRATION - March 18, 2002

25.       Authorization to Accept Offer on Parcel/Property M8SW3-2-41/Wo

Concord Drive - Northampton County Repository Sale

INFORMATION:

Parcel/Property M8SW3-2-41/Wo Concord Drive, was turned over to the Northampton County Tax Claim Bureau for collection of delinquent school district real estate taxes. A judicial sale in 1997 was unsuccessful, and the property was held in the County Repository. Subsequent attempts to sell the property were also unsuccessful. On February 6, 2002, the school district received notification from the Tax Claim Bureau that a $500 bid was tendered on the property. At the time the property was presented for collection of delinquent taxes, it had an assessed value of $1,300.

Pennsylvania Real Estate Tax Law (Sec. 627) requires the Tax Claim Bureau to obtain written consent from the taxing district to accept an offer of any price for the property placed in the Òrepository for unsold propertiesÓ without court approval and published notice of sale. The taxing district may not unreasonably withhold its consent to the sale of the property.

The Tax Claim Bureau has evaluated the offer and considers it to be a fair offer and desires the property to be sold.

RECOMMENDATION:

That the Board of School Directors authorizes the administration to send the Tax Claim Bureau written consent to accept the offer of $500 for Parcel/Property M8SW3-2-41/Wo Concord Drive.
